Dear NPNY members,
As part of New York's response to the COVID-19 pandemic, Governor Andrew Cuomo issued Executive Order 202.10 on March 23rd which temporarily suspend certain laws and regulations related to health care providers and facilities.
Pertaining to Nurse Practitioners in particular, the order temporarily suspends requirements for a collaborative relationship or written practice agreement with a physican and provides protection from civil or criminal penalty related to the lack of a written practice agreement or collaborative relationship.
The order also allows Nurse Practitioners and Registered Nurses who are in good standing in New York State to practice in NYS without cival or criminal penalty related to lack of registration.
In addition: (AANP)
- Protects nurse practitioners, along with certain other health care providers, from civil liability for injury or death alleged to have been sustained directly as a result of an act or omission by such medical professional in the course of providing medical services in support of the COVID-19 outbreak.
- Relieves health care providers of recordkeeping requirements to the extent necessary to perform tasks as may be necessary to respond to the COVID-19 outbreak, including, but not limited to, requirements to maintain medical records that accurately reflect the evaluation and treatment of patients, or requirements to assign diagnostic codes or to create or maintain other records for billing purposes.
- Requires health insurance companies to provide a list of all persons with a professional licensure or degree as a nurse practitioner, registered nurse, practical nurse, medical doctor, or physician assistant and the status of that license in order for the Department of Financial Services to poll such individuals to determine whether they would serve in the COVID-19 response effort.
- Authorizes health care facilities to allow students in health care professional programs to volunteer at the facility for educational credit as if the student had secured a placement under a clinical affiliation agreement, without entering into any such agreement.
